What happened?
On February 28, 2025, Governor Kim Reynolds signed Iowa Senate File (SF) 418 into law. This legislation addresses issues related to sex and gender, including definitions based on biological characteristics, recording sex on vital records, and provisions related to gender identity and school curricula.
Overview:
SF 418 aims to strengthen protections against employment discrimination and ensure equal treatment in the workplace while allowing certain exemptions for religious institutions. While state law no longer protects gender identity, employers are encouraged to continue treating it as a protected category to avoid penalties under municipal or local laws and potential federal legal issues.
Key Changes and Impact on Employment:
- Gender Identity and Civil Rights:
The bill removes “gender identity” as a protected class in the Iowa Civil Rights Act, which affects employment, wages, public accommodations, housing, education, and credit practices. However, gender identity remains protected under federal law and certain municipal ordinances. - Job Posting System:
The Department of Workforce Development, in consultation with the Department of Education, must establish an internet-based job posting system. This system must allow for electronic submission of job openings and include a non-discrimination statement. - Equal Pay:
reinforces the prohibition of wage discrimination based on sex, sexual orientation, gender identity, and other protected characteristics. Employers must ensure equal pay for equal work.
